User Agreement of Nawatik
Welcome to Nawatik!
This User Agreement (“Agreement”) governs your access to and use of the digital services, websites, applications, and solutions provided by Nawatik (“Nawatik”, “We”, “Us”, or “Our”).
By accessing or using any of Nawatik’s services, you (“User”, “Client”, “You”) agree to be bound by the terms and conditions set forth in this Agreement.
If you do not agree with any part of this Agreement, you must immediately discontinue the use of our services.
1. Eligibility
You must be at least 18 years old or have the legal capacity to enter into binding agreements to use Nawatik’s services.
By using our services, you represent and warrant that you meet these requirements.
2. Services Provided
Nawatik specializes in providing tailored digital solutions, including but not limited to:
Website Development
E-Commerce Solutions
Branding and Graphic Design
Social Media Management
Advertising and Marketing Campaigns
Consulting and Technical Support Services
Service specifics are outlined individually in your chosen package or agreement.
3. Account Responsibility
If access to Nawatik’s services requires account creation, you are responsible for:
Providing accurate, complete, and updated information.
Safeguarding your account credentials.
Notifying Nawatik immediately of any unauthorized use or security breach.
You are liable for all activities conducted under your account.
4. Client Obligations
As a User, you agree to:
Provide all requested information, materials, and approvals in a timely manner.
Ensure that all provided content complies with legal standards and does not infringe upon third-party rights.
Abide by all applicable laws and regulations when using Nawatik’s services.
5. Payment Terms
Fees for Nawatik’s services are determined by your selected service plan or customized agreement.
Invoices must be paid as specified in the billing terms. Failure to pay may result in service suspension or termination.
6. Intellectual Property
All content, designs, software, and solutions created by Nawatik remain Nawatik’s intellectual property unless otherwise agreed in writing.
Upon full payment, you receive a non-exclusive, non-transferable right to use the deliverables for your business purposes.
Reproduction, resale, or distribution without explicit written permission is prohibited.
7. Termination
Either party may terminate this Agreement:
By providing written notice in accordance with the termination terms of your agreement.
Immediately, if there is a material breach by the other party.
Upon termination, all outstanding fees remain payable.
8. Limitations of Liability
Nawatik strives to deliver services with the highest level of professionalism; however, we are not liable for:
Delays or failures caused by factors outside our control.
Indirect, incidental, or consequential damages.
Any losses resulting from Client’s misuse or misapplication of deliverables.
Our total liability shall not exceed the amount paid by the Client for the service in question.
9. Privacy and Data Protection
Nawatik is committed to protecting your privacy and personal data.
Our data collection, storage, and usage practices are governed by our Privacy Policy, in compliance with applicable data protection laws.
10. Changes to the Agreement
Nawatik reserves the right to amend this User Agreement at any time.
Changes will become effective upon posting. Continued use of services after updates constitutes acceptance of the new terms.
11. Governing Law
This Agreement is governed by and construed in accordance with the laws of the Kingdom of the Netherlands, without regard to conflict of law principles.
